A 10-month-old baby has died just hours after he was taken home by his parents following a legal battle with the hospital that was looking after him.

Little Nick Torres was found unconscious in a bath at home last month and rushed to Texas Children's Hospital. He was declared brain dead by doctors but his desperate parents Mario and Ana Patricia, took them to court in a bid to keep him hooked up to a ventilator.

A Texas appeals court on Friday denied an emergency appeal filed by Nick's parents as they argued that Nick was alive because his heart was beating on its own.
