ISIS bride Shamima Begum could yet return to the UK due to the government failing to consider whether she was trafficked out of Britain to Syria and is therefore a victim.
Begum's lawyer has claimed that her wish to return to the UK is strengthened by a recent court case of a 16-year-old from Derbyshire who was groomed into a modern-day slavery victim.That particular case was a milestone legal moment as it provided the sexual exploitation proved justification for the terrorism prosecution to be thrown out.Speaking after the case, Shamima Begum's lawyer argued this should also have been applied to Shamima's case too.He said: "Shamima has been arguing this from the beginning."This just strengthens her case."Speaking to the Sun, Jonathan Hall QC, the independent reviewer of terrorism legislation described why the case was so important.
He said: "Being both a victim of modern slavery and presenting a risk to the general public are not incompatible."If fewer criminal cases are going to be possible, this begs the question whether there are sufficient non-criminal justice measures in place, in particular, to deal with the terrorist risk presented by children."Since leaving for Syria in 2015, Shamima has made numerous attempts to return to the UK through legal means.
