A single mum sacked from her job after eating a sandwich is suing the company for unfair dismissal. Gabriela Rodriguez tucked into the £1.50 tuna snack after it was thrown away at a law firm.
She was paid off from her job as a cleaner by Total Clean and has now started legal proceedings against them. The 39-year-old, originally from Ecuador, claims she was unfairly dismissed.The firm was contracted to leading civil law firm Devonshires.
The Mirror reports following a disciplinary hearing last year, Graham Petersen, the boss of Total Clean, sent Gabriela a letter.It stated: "Your explanation was that you found a sandwich in the kitchen near the end of your shift and took it without giving it a second thought.
You stated that previously the client had left food in the kitchen and offered it out, so you thought it was fine."I considered your explanation to be unsatisfactory because you confirmed that no one had offered you the food in the kitchen but decided to take it anyway."I have decided that your conduct has resulted in a fundamental breach of your contractual terms which irrevocably destroys the trust and confidence necessary to continue the employment relationship."In the letter, reported in the MailOnline, he claims to have considered whether he could have avoided dismissing her.
