after revealing on RHOBH that is also refusing to give up her $40K glam squadBut in legal documents obtained by PEOPLE, it is stated that Erika claims she does not have the 'ability' to pay the California tax board, after receiving a notice from administers in May this year.The filing reads: 'I am in the midst of trying to figure out the basis of this tax bill with the assistance of my business manager, who is also an accountant.

I do not have the ability to pay the [California Franchise Tax Board] tax bill.'Erika states in the docs that she is unsure if the tax board is 'claiming any sort of lien' in regards to her $750,000 pair of earrings which she has been asked to return due to Tom's bankruptcy case.It had been previously alleged in court filings that the earrings were bought via at client trust at Tom's law firm Girardi Keese and written off as part of tax expenses.
