A cidermaker has won an appeal in a long-running 'copycat' trademark battle with Aldi. Thatchers sued the discount supermarket in 2022 for infringing the trademark of its Cloudy Lemon Cider.
The Somerset based firm claimed Aldi's Taurus lemon cider had gained an 'unfair advantage' by copying the drink in 'taste and appearance'.
Thatchers claimed Aldi was 'misleading shoppers to believe that the ciders are the same, or in some way linked'. But last January the High Court dismissed Thatchers' case.
In her ruling Judge Melissa Clarke said there was a low degree of similarity between the products and 'no likelihood of confusion' for costumers.
