But the 23-year-old denied the charge and lodged a special defence of consent at his trial at Paisley Sheriff Court. Yesterday a jury found the charge against McNally, of Renfrew, near Glasgow, not proven by a majority.
The woman had claimed she was unable to consent to any sex acts because she was drunk and asleep. She also told the court she would not have consented to any sexual activity between them because she was a lesbian.She said: "He was told just before this incident.
